1 General Aspects
These General Terms and Conditions of Business (hereinafter General Conditions) will regulate the commercial relationship between Fanatic Guitars SLU (hereinafter Fanatic Guitars) and the user or customer for the contract made through the forms that Fanatic Guitars makes available to them on its website www.fanaticguitars.com
Purchasing through the Fanatic Guitars websites will imply the express acceptance, by the customer or user of the page, of these conditions, as well as the conditions of use established for the user’s navigation through the page owned by Fanatic Guitars. These conditions will be applicable without prejudice to the application of the legal regulations on the matter that are applicable to each case.
These General Conditions are subject to the provisions of Law 7/1998, of April 13, on General Conditions, to Law 26/1984, of July 19, General for the Defense of Consumers and Users, at Royal Decree 1906/1999, of December 17, 1999, which regulates Telephone or Electronic Contracting with general conditions, Organic Law 15/1999, of December 13, on the Protection of Personal Data, Law 7 / 1996, of January 15th, on the Regulation of Retail Trade, and Law 34/2002 of July 11th, on Information Society Services and Electronic Commerce.
Fanatic Guitars reserves the right to make the modifications it deems appropriate, without prior notice, in the General Conditions. These modifications may be made through their websites by any form admissible by law and shall be binding during the time they are published on the website and until they are validly modified by subsequent ones. However, Fanatic Guitars reserves the right to apply, in certain cases, Specific Business Conditions in preference to these General Conditions when it deems it appropriate, announcing them in a timely manner.

2 Purchase process
The following General Conditions will be applicable to the commercial relationships established between Fanatic Guitars and the customer. Customers may be both natural persons who act with a purpose other than a commercial, business or professional activity, whether collective or independent (consumers) or those natural or legal persons (in any of its forms) that establish the commercial relationship with a purpose related to their commercial, business or professional activity, whether for a group or for an individual (employer).
By clicking on the “Place order” button, the commercial relationship is established for the goods requested in the “Shopping cart”, confirming this immediately afterwards through an order confirmation email. Once this confirmation is received via email, a binding commercial relationship (contract) of purchase and sale is established between Fanatic Guitars and the customer.
Once the purchase is made, the user will see the confirmation of their order on the screen, being able to print it as proof of purchase.
The order confirmation and proof of purchase (printing made by the user) will not be valid as an invoice. The invoice will be sent by email once the purchase is completed. In addition, it will be accessible from the download area from the customer’s personal area on our website.
In compliance with current regulations and, especially with Law 34/2002 on services of the information society and electronic commerce, Fanatic Guitars offers information on all products for sale, their characteristics and prices.
However, the availability of the products offered by Fanatic Guitars through its web pages may vary depending on customer demand. Fanatic Guitars reserves the right to terminate the contract in the event that the product (s) and / or any type of requested product is not available, in which case the customer will be informed as soon as possible. Likewise, Fanatic Guitars could proceed to the termination of the contract in the event that the product has been damaged and / or any error has occurred in the specification, description or price shown in our website. The payment (s) that had been made in advance will be returned as soon as possible, leaving Fanatic Guitars excluded from any other right to claim.
By purchasing with Fanatic Guitars through its website, the user or customer expressly declares to know, understand and accept these general conditions. The user is responsible for treating confidentially and responsibly the identity and password obtained in the registration as a customer, not being able to transfer them to another.
3 Statutory right of withdrawal
Right of withdrawal
The customer, as long as he is a consumer (as established by Royal Legislative Decree 1/2007 of November 16, which approves the Consolidated text of the TRLDCU Law), will have the right to revoke the contract within fourteen days without giving any explanation. The withdrawal period is established in fourteen days from the day on which the consumer, or any person on his behalf, excluding carriers, has accepted and taken possession of the last product delivered.
In order to exercise the right of withdrawal, the customer must inform Fanatic Guitars by means of a clear statement (for example, a letter sent by post or email) about his decision to cancel the contract. To meet the return period, it is sufficient to send the customer’s decision to revoke the contract before the deadline set out above.
Consequences of withdrawal
Fanatic Guitars will reimburse the price of the product and the ordinary shipping costs corresponding to the cheapest shipping option that we offer, excluding therefore those additional costs that derive from a type of delivery chosen by the customer, different from the cheapest standard type offered by us, such as Express or urgent deliveries.
The refund must be made immediately and at the latest within fourteen days from the day on which the communication on the revocation of the contract was received. For the return, the same form of payment that the customer used in the initial transaction will be used, unless agreed with the customer in a different way.
In the case of goods that can be sent in parcels, Fanatic Guitars reserves the right to deny the return of the payment until these goods are received back or the customer has credited the return, depending on what occurs first.
Warnings about withdrawal
Since the customer is responsible for the packaging to transport the goods safely, in case of exercising the right of withdrawal, it is recommended to keep the original packaging for at least a period of fourteen days, since the product must arrive in perfect condition.
The assumption of the return costs will only be valid for the return made from the agreed delivery place (and not to a different address, not in another country), within the territory of mainland Spain. In the event that a return or collection must be made from an address other than that specified as the place of delivery in the order, the customer is hereby advised that he may have to bear the additional return’s shipping costs.
Exclusions from the statutory right of withdrawal
The right of withdrawal does not apply to the delivery of:
- Goods that are not prefabricated and that are clearly tailored to the personal requirements of the consumer or for whose manufacture the individual selection or determination by the consumer is decisive, for example by selecting materials, configurations, etc. different from those presented in the catalog.
- Sealed goods that for reasons of health protection or hygiene are not suitable for return, such as in-ear headphones, mouthpieces for wind instruments, etc. or when the seal has been removed after delivery.
- Audio or video recordings or computer programs in sealed packaging when the seal has been removed after delivery.
- Any digital content (including apps, digital software, e-books, MP3, etc.) that had not been delivered on a material medium.
4 Return Policy and Warranty
Products sold online by Fanatic Guitars may be returned within 14 calendar days from receipt, unless any of the exceptions are applicable, and provided they are in the same condition in which they were received. For more information, click here.
When returning the products according to this return guarantee, Fanatic Guitars will refund the price of the paid product, as well as the initial shipping costs corresponding to the cheapest standard shipping method offered by Fanatic Guitars, and in no case other shipping costs agreed with the customer, such as urgent services, express, etc. The customer will bear the costs of returning the goods, as well as any damage to the goods caused by transportation.
Legal Guarantee of Conformity
In addition to the legal right of revocation and the return guarantee, customers in the European Union will have an after-sales guarantee, of two years from the date of delivery of the product, for the repair or replacement of products purchased in Fanatic Guitars if they are found to be defective or not in accordance with the announcement.
In the case of second-hand products, the warranty period will be one year from receipt of the goods.

5 Indication of prices
The prices indicated on the web will be those in force at all times. Each product offered will have its price indicated and if it includes VAT or any other applicable tax, depending on the place of delivery chosen by the customer.
Shipping costs are borne by the user and will be added to the total amount of the selected products once the order has been placed, with the exception of free shipping offers.
Please note that if you buy our products from a country outside the EU, you may have to pay import taxes, which vary depending on the laws of your country. Fanatic Guitars will not be responsible for this amount. For this reason, we recommend that the customer consult with the corresponding authorities or customs agencies prior to their purchase.
